Before getting married, some couples choose to enter a prenuptial (or antenuptial) agreement with their soon-to-be spouse. The prenuptial agreement is a written contract reviewed and signed by both parties in advance of the wedding to describe and protect the assets that each have acquired prior to the marriage. The prenuptial agreement should be signed a minimum of thirty (30) days prior to the wedding date, so it is advisable to plan early if prenuptial legal counseling or agreements are desired. Each spouse should have a separate attorney representing their individual interests to review and execute the agreement. In the event of a divorce or legal separation, the prenuptial agreement should control the division of assets and liabilities in the manner documented and agreed to in advance of the wedding vows.
