New Hampshire has a statute authorizing grandparents to seek Court orders for visitation with their grandchildren. A petition for grandparent visitation may be filed requesting a specific schedule of visits separate from the time spent with the children together with either one of the parents. When ruling on a request for grandparent visitation, the Court will take into consideration the amount of time that the children have historically spent with the grandparents and the level of friction between the grandparent and the parent(s). If you are a grandparent seeking a Court order for a visitation schedule, you will need to demonstrate that it is in the best interests of the grandchildren to spend time with you on a specific schedule. This decision will rest in part on whether the visitation will interfere with the relationship between the parent and the child.
