Neutral Evaluation
Neutral Evaluation is a process through which the parties to a legal dispute select a neutral third person to provide an opinion about the potential outcome of their legal dispute. A neutral evaluator hears a summary presentation of each side of the case and then tells the parties his or her opinion of the likely outcome of the case, if it were to be heard and decided by a judge. The opinion of the neutral evaluator may help the parties to reconsider positions taken in previous negotiations, or it may assist the parties in initiating concerted settlement efforts. Parties may be more likely to negotiate an agreement if they have received the opinion of a neutral evaluator concerning the potential result of costly and time-consuming litigation.
